Wrongful Death

Wrongful Death Attorney In Phoenix

Losing a loved one is an incredibly difficult event to go through. When someone else’s negligence is the cause of your loved ones death, it makes it even harder to deal with.

If your loved one died from the negligence of another person, it is important that you consult with a personal injury attorney. Our legal team works on a contingency fee. This means that you do not need to pay anything when you retain us unless we win your case. At that point, we would take a percentage of compensation as our attorney retainer fee. We offer free case evaluations to help you determine what your next steps need to be.

Types of Compensation in Wrongful Death Claims

In your wrongful death claim, you may be able to collect compensation for your loss. Some losses are common to all wrongful death claims, but there are some instances that are specific to the relationship with the deceased. Some of those instances are:

  • Loss of Parents: Children who have lost their parents due to the negligence of someone else may recover compensation for the loss of companionship and mental anguish of losing their parents. Minor children may also collect compensation for the loss of financial support that their parents or parents would have provided.
  • Loss of Children: Parents who have lost their child or children may recover compensation for the loss of companionship of their child and for mental anguish.
  • Loss of Spouse: A husband or wife may collect compensation for the loss of the significant other for the loss of companionship[ and mental anguish. A spouse may also be able to collect compensation for the lifetime of income and services that would be lost by the loss of their significant other.

Deadlines to File a Wrongful Death Lawsuit in Arizona

Every state has their own deadlines in which the family or estate must file a lawsuit over a wrongful death. In Arizona, under A.R.S. Section 12-542, a wrongful death lawsuit must be filed within two years of the date of the deceased person’s death. The filing of the lawsuit is not affected by any criminal case that may be filed.

I hired Justin to represent my daughter after we were in a car accident. Justin explained the whole process to me and made the process simple to understand. I highly recommend Justin to anyone who needs a personal injury lawyer.

Erica G.

Justin is a fantastic attorney. I have a few clients that used him and were thrilled with their results! If you need a personal injury attorney he is your man.

Sharmen R.

Justin is the real deal.  He is skilled, caring and very knowledgeable.  One of a kind in the business ...

Randy C.

Justin is the best! His staff is amazing too! He's your go-to guy for all accident cases. My only complaint is that my wife thinks he's cute and it makes me uncomfortable. Lol. Thanks for the money Justin!

James O.

Justin was amazing dealing with a non-injury accident we experienced. He was able to get the at fault's insurance to pay despite the driver denying any wrong doing initially. He was quick to get a resolution for us so we could get repairs taken care of. Thanks, Justin!
