Types of Compensation in Wrongful Death Claims

In your wrongful death claim, you may be able to collect compensation for your loss. Some losses are common to all wrongful death claims, but there are some instances that are specific to the relationship with the deceased. Some of those instances are: 

  • Loss of Parents: Children who have lost their parents due to the negligence of someone else may recover compensation for the loss of companionship and mental anguish of losing their parents. Minor children may also collect compensation for the loss of financial support that their parents or parents would have provided. 
  • Loss of Children: Parents who have lost their child or children may recover compensation for the loss of companionship of their child and for mental anguish.

A spouse may also be able to collect compensation for the lifetime of income and services that would be lost by the loss of their significant other.

Deadlines to File a Wrongful Death Lawsuit in Arizona

Every state has their own deadlines in which the family or estate must file a lawsuit over a wrongful death. In Arizona, under A.R.S. Section 12-542, a wrongful death lawsuit must be filed within two years of the date of the deceased person’s death. The filing of the lawsuit is not affected by any criminal case that may be filed.
