How long after an accident do I have to file a personal injury claim?
In Nevada, injured victims have two years from the date of injury to file a personal injury claim. The statute differs for minor children or other “disabilities,” including incarceration. It’s best to contact an attorney immediately after a car crash or other accident.
Can I still recover damages even if I was partially responsible for my accident?
Maybe. Nevada follows a “modified comparative negligence” rule in personal injury cases. You may recover damages if you’re 50% or less at fault in an accident. You cannot recover anything if you’re 51% at fault or greater. If you’re 50% or less at fault, your recovery is reduced by your percentage of fault.
For instance, if you’re found to be 20% at fault in the accident, and the total award was
$100,000, you can still recover $80,000.
What should I do and not do after an auto accident to improve my case?

Do:
- Exchange insurance with the other driver. Nevada is an at-fault state for insurance. In an auto accident, drivers file claims with the other driver’s insurance company. It’s always best to exchange information with the other driver immediately.
- Seek medical attention immediately. Some types of injuries, including head trauma, neck injuries, and even some broken bones, can take hours or days to develop. Getting immediate treatment provides evidence for your claim.
- Gather as much evidence as you can. Get the other driver’s name and contact information, photos of the accident scene, and names of any witnesses, if possible. If you cannot do it yourself, ask someone on the scene to get this information for you.
Don’t:
- Admit fault or apologize. It’s a common human response to say, “I’m so sorry,” but try not to do anything more than that. Never admit any fault or say you’ll pay for any damage.
- Post anything on social media. Although this is how everyone communicates these days, it can damage your case if the insurance company sees pictures of you looking healthy and happy.
